Each client declares that he/she has full capacity to use credit cards and that the same have sufficient funds to cover all costs resulting from the reservation at Villa Marques del Rio.
1. Availability
Villa Marques del Rio will do its utmost to please all its clients in the demand for its services.
In case of unavailability of the accommodation after the booking has been made, the client will be informed by e-mail of the cancellation of the booking.
Following this request, the speed of the refund to the customer’s bank account will depend on the type of bank card and the conditions of each bank. These deadlines are again specified in the ‘Delivery’ clause.
2. Guarantee
Guarantees and after-sales services are governed by Royal Legislative Decree 1/2007 of 16 November, which approves the text of the General Law for the Defence of Consumers and Users. According to this regulation, the seller is obliged to deliver to the consumer and user products that are in accordance with the contract, and is liable to the consumer and user for any lack of conformity. The consumer and user has the right to have the product repaired, replaced, the price reduced or the contract rescinded.
3. Methods of payment
3.1. Reservation
By clicking on the ‘Pay’ button during the booking process, the member declares to fully and unreservedly accept the entirety of these Terms and Conditions.
The data recorded by https://villamarquesdelrio.es, constitute proof of the transactions between Mihaela Horumbete and the tenants of Villa Marques del Rio.
Villa Marqués del Río will confirm your reservation by sending you an e-mail.
The contractual information shall be provided in English, Spanish or Romanian and shall be confirmed at the latest at the time of delivery.
All taxes are included in the booking prices. Throughout the booking process, you will be informed of any supplements, such as the security deposit or cleaning tax, so that you can be shown the full amount to be paid at the end of the booking process.
Villa Marqués del Río reserves the right to modify the prices at any time, but the reservation will be invoiced on the basis of the rates in force at the time of registration of the reservation, except for obvious typographical errors.
Villa Marques del Rio reserves the right to refuse a reservation from any prospective tenant with whom it has a dispute.
3.2. Methods of payment
Bank transfer.
This payment method is free of charge for the customer.
The amount of the returns will be charged to the account indicated by the customer.
In order to make payment of an invoice, the following must be stated:
- Invoice number.
- Name of the person or company that enters it.
- It should be addressed to Villa Marqués del Río at the account number provided.
- Send proof of payment to the following e-mail address: contacto@villamarquesdelrio.es.
- Please include proof of payment in the subject line.
Payment by credit card.
Purchases are settled by bank card. The bank cards accepted are: Visa, American Express and MasterCard. The purchase price will be debited from the customer’s bank account within 4 days from the day of the order and will be considered effective after confirmation of agreement from the bank payment centres.
In the event that the POS (Point of Sale Terminal) informs of the refusal of the card, the order will be automatically cancelled, informing the customer on-line of this cancellation.
PayPal.
In this modality the payment will be charged according to what the client has contracted with PayPal, in the same way the returns where Villa Marqués del Río has to pay any amount will be made by the same way.
There is no cost to the client for this modality.
3.3. Security
For your security, Villa Marqués del Río has entrusted the credit card payment system to a payment gateway.
The bank details entered are encrypted and securely transmitted to the bank’s servers and then verified with the issuing bank to prevent fraud and abuse.
This data entry procedure is guaranteed by 128-bit SSL (Secure Socket Layer) encryption technology, one of the most advanced and effective protection systems currently available, which means that no third party will have access via the Internet to this information relating to the banking data entered by the customer.
Only the Bank has access to the bank details linked to these means of payment, so Villa Marqués del Río does not know or register these details during the payment transaction.
4. Reservation
The booking information will be available at Villa Marqués del Río, once the payment is confirmed, which can be viewed via the link: ‘My account’, as soon as the email is sent. The final price of the booking includes all service fees and VAT.
Villa Marqués del Río will inform the client of the booking confirmation by sending an e-mail.

5. Cancellation
In case of cancellation of the reservation, the following penalties will be applied according to the time of anticipation with respect to the planned date of arrival:- Cancellation more than 10 days in advance: No penalty will be applied. Cancellation is completely free of charge.
- Cancellation 9 days in advance: A penalty of 5% of the advance payment will be applied.
- Cancellation between 8 and 6 days in advance: A penalty of 20% of the advance payment will be applied.
- Cancellation between 5 and 3 days in advance: A penalty of 50% of the advance payment will be applied.
- Cancellation with 2 days or less notice: A penalty of 100% of the advance payment will be applied.
- Exception due to force majeure: In the event of cancellation due to duly accredited causes of force majeure, no penalty will be applied, and the advance payment will be refunded in full.
6. Liability, litigation and applicable law
Villa Marques del Rio cannot be held responsible for the non-performance of the contract concluded in the event of stock shortage or unavailability of the product, force majeure, total or partial disruption or strike, in particular of postal services and means of transport and/or communications, flood or fire. In the event of a dispute, the member shall give priority to Villa Marques del Rio in order to obtain an amicable solution.
The Courts of Guadalajara are the only competent courts. These general terms and conditions of sale shall be interpreted in the Spanish language and shall be carried out in accordance with Spanish law. Any disagreement that may arise in relation to their validity, interpretation or execution shall be submitted to the Courts of Guadalajara, to which exclusive jurisdiction is expressly attributed.
7. Modification of terms and conditions
Villa Marqués del Río reserves the right to modify the terms and conditions of sale without prior notice, being able to change, delete or add both the contents and services provided through it and the way in which they are presented or located on its servers.
These changes must be accepted by the User each time he/she makes a purchase through the Villa Marqués del Río website.
Potential tenants who do not agree with the modifications of the terms and conditions, must notify and, from the date on which the new version will enter into force, must stop using the Villa Marqués del Río services. In the event of any of the terms of the general conditions being illegal or unenforceable, it will be null and void and the terms agreed by the parties will be applied, failing which the Spanish Civil Code will be applied.
